This Terms of Use Agreement (“ToU”) is entered into between Studio Wes (“Studio Wes,” “we,” “us,” or “our”) and you, the individual accessing or purchasing our digital products or services (“you” or the “user”).

SERVICES THIS TERMS OF USE COVERS

Studio Wes is a design-forward creative studio offering digital website templates and design assets intended for creative businesses and entrepreneurs. This ToU applies to all Squarespace website templates and Canva-based templates offered for purchase through the Studio Wes website (collectively, the “Services”).

SERVICES THIS TERMS OF USE DOES NOT COVER

Our website may contain links to third-party websites, platforms, or services. When you click on one of these links, you are leaving the Studio Wes website, and this ToU no longer applies. Studio Wes is not responsible for the content, policies, or practices of any third-party websites or services.

ACCEPTANCE OF TERMS

By purchasing, accessing, or using any Studio Wes Services, you agree to be legally bound by this ToU and our Privacy Policy. If you do not agree, please do not use our Services.

CHANGES TO TERMS

Studio Wes may update or revise this ToU at any time. Any changes will be effective immediately upon posting. Continued use of our Services following any update constitutes acceptance of the revised ToU.

ELIGIBILITY

Our Services are not intended for individuals under the age of 13. If you are under the age of 18, you must have permission from a parent or legal guardian to use our Services. To purchase any Studio Wes digital products, you must be at least 18 years old and legally able to enter into this agreement.

SQUARESPACE & CANVA REQUIREMENTS

All Studio Wes website templates are designed exclusively for use on the Squarespace platform. To use a Squarespace template, you must have an active Squarespace account and an appropriate hosting plan. Squarespace subscriptions and domains are not included in your purchase.

All Studio Wes design templates are created for use within Canva. You are responsible for maintaining your own Canva account (free or paid, depending on the template requirements). Canva subscriptions are not included in your purchase. Studio Wes is not affiliated with Squarespace or Canva.

SINGLE-USE LICENSE

Studio Wes grants you a non-exclusive, non-transferable, single-use license to use each purchased template for one website or one end use only.

You may not:

• Resell, sublicense, share, distribute, or duplicate any template

• Use the template for multiple websites, brands, or clients

• Offer the template for free or for sale to any third party

• Claim the template as your own original work

If you wish to use a template for additional projects or clients, you must purchase an additional license.

TEMPLATE AVAILABILITY

Studio Wes does not guarantee that any template will remain available for purchase. Templates may be released in limited quantities or discontinued at our discretion.

PRICING & PAYMENT

All prices are listed at the time of purchase and are subject to change without notice. Full payment is due at checkout unless otherwise stated. Payments are processed through secure third-party payment processors. Studio Wes does not store or have access to your payment information.

NON-REFUNDABLE DIGITAL PRODUCTS

Due to the digital nature of our products, all sales are final. Once access to a template has been delivered, no refunds, exchanges, or cancellations will be issued.

DELIVERY & ACCESS

After successful payment, you will receive access to your purchased template via email or download link. It is your responsibility to ensure that the email address provided at checkout is accurate. If you experience issues accessing your purchase, please contact Studio Wes within a reasonable timeframe.

IMAGERY, GRAPHICS & FONTS

Any demo imagery shown in template previews is for illustrative purposes only and is not included unless explicitly stated. Any graphics or fonts included within a template are licensed for use only within that template and may not be extracted or reused for other purposes.

CUSTOMIZATION & MODIFICATIONS

You are welcome to customize your purchased template to reflect your brand. However, any customization does not create a new product and does not grant you the right to redistribute or resell the template in any form.

CREDIT

Studio Wes templates may include a subtle design credit. We kindly request that this credit remain intact unless otherwise agreed to in writing.

PROMOTIONAL USE

Unless you notify Studio Wes in writing, you grant us permission to showcase your completed website or design using our template for portfolio, educational, or marketing purposes, with appropriate credit to your business.

INTELLECTUAL PROPERTY

All templates, designs, content, and branding remain the exclusive intellectual property of Studio Wes. Purchase grants a limited license only and does not transfer ownership.

DISCLAIMER OF WARRANTIES

Studio Wes Services are provided “as is” and “as available.” We make no guarantees regarding business outcomes, website performance, traffic, or conversions.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Studio Wes shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Services. Studio Wes’s total liability shall not exceed the amount paid by you for the applicable product.

INDEMNIFICATION

You agree to indemnify and hold harmless Studio Wes from any claims, damages, losses, or expenses arising from your use of the Services or violation of this ToU.

GOVERNING LAW

This ToU shall be governed by and construed in accordance with the laws of the State of California and Indiana.
